Terms of Service

These terms are the agreement between you and Lyfsoft Technologies (operating as LyfHost) for the use of our hosting, domain and related services. Please read them carefully. Using our services means you accept them.

Welcome to LyfHost, the web hosting and domain division of Lyfsoft Technologies ("LyfHost", "we", "us" or "our"). These Terms of Service (the "Terms") govern your access to and use of our websites, hosting plans, domain registrations, SSL certificates, control panels, support and any other products or services we provide (collectively, the "Services"). By creating an account, placing an order, or using any part of the Services, you ("you", "the customer" or "the account holder") agree to be bound by these Terms.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity. If you do not agree with these Terms, you must not use the Services.

1. Acceptance of Terms

By signing up for, purchasing, or using any of the Services, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and legally capable of entering into a binding contract. You also agree to comply with these Terms together with our Acceptable Use Policy, Privacy Policy and Refund Policy, each of which is incorporated into these Terms by reference.

These Terms apply in addition to any plan-specific terms shown at checkout. Where a specific plan or promotion has its own terms, those terms take precedence to the extent of any conflict.

2. Account Registration & Responsibility

To use most Services you must register an account and provide accurate, current and complete information. You are responsible for keeping your account information up to date and for maintaining the confidentiality of your login credentials, including any sub-accounts you create (for example, additional cPanel or email accounts).

  • You are fully responsible for all activity that occurs under your account, whether or not authorised by you.
  • You must notify us immediately at support@lyfhost.in if you suspect any unauthorised access or security breach.
  • Providing false, misleading or fraudulent registration details may result in suspension or termination of your account.
  • You may not transfer or resell your account to a third party without our prior written consent.

3. Acceptable Use Policy

You agree to use the Services lawfully and responsibly. The following activities are strictly prohibited and may result in immediate suspension or termination without refund:

  • Illegal content: hosting, distributing or linking to content that is unlawful, infringing, defamatory, obscene, or that exploits minors or violates the rights of others (including intellectual property and privacy rights).
  • Spam & abuse: sending unsolicited bulk email (spam), operating mailing lists without verified opt-in, email header forgery, or any activity that gets our IP ranges blacklisted.
  • Malware & attacks: distributing viruses, trojans, ransomware or phishing pages, or using the Services to launch hacking attempts, port scans, brute-force or denial-of-service attacks.
  • Resource abuse: on web and WordPress hosting plans, sustained excessive use of CPU, RAM, I/O, inodes or processes that degrades service for other customers. "Unlimited" and "unmetered" resources are subject to fair-usage limits described at checkout.
  • Prohibited applications: public file-sharing/torrent trackers, crypto-mining, proxy/anonymiser services, bulk SMS gateways, or running background processes unrelated to a hosted website on shared environments.
  • Fraud: chargeback fraud, payment-card testing, lottery/pyramid schemes, or any deceptive or fraudulent business practice.

We reserve the right to determine, at our reasonable discretion, what constitutes a violation of this Acceptable Use Policy, and to investigate and take appropriate action, including content removal, throttling, suspension or termination, to protect our network and other customers.

4. Service Availability & SLA

We are committed to keeping your site online. LyfHost targets a 99.9% network uptime for all web and WordPress hosting plans, measured monthly and monitored every 60 seconds across our data centers.

  • If we fail to meet the committed uptime in a given calendar month, you may request a service credit calculated as a pro-rated portion of that month's hosting fee, applied to a future invoice.
  • Service credits are the sole and exclusive remedy for any failure to meet the uptime commitment, are not redeemable for cash, and must be requested within 30 days of the affected period.
  • The SLA does not apply to downtime caused by: scheduled or emergency maintenance (for which we provide reasonable notice where practicable), issues outside our network (such as your code, third-party software, DNS at another provider, or your local connection), force majeure events, or suspensions resulting from your breach of these Terms.

5. Billing, Renewals & Payment

Service fees are billed in advance for the term you select (monthly, annual or multi-year) and, for Indian customers, are quoted in Indian Rupees (₹) inclusive of applicable GST, with a tax invoice provided. We accept UPI, major credit and debit cards, net banking and PayPal.

  • Auto-renewal: to prevent service interruption, eligible Services renew automatically at the then-current price using your saved payment method. We send renewal reminders in advance, and you may disable auto-renewal at any time from your client area.
  • Promotional pricing: introductory and discounted rates apply to the first term only; renewals are charged at the standard published rate unless stated otherwise.
  • Late or failed payment: if an invoice is not paid by its due date, we may suspend the Service. Unpaid hosting accounts may be suspended after the due date and terminated, with data deleted, if the balance remains unpaid for an extended period (typically 15 to 30 days).
  • Domain & SSL fees are generally non-refundable once a registration, renewal, transfer or issuance has been completed, because they are paid to third-party registries and certificate authorities on your behalf.
  • Price changes: we may revise pricing for future terms; any change will apply from your next renewal, never mid-term.

6. Refunds & Money-Back Guarantee

We offer a 30-day money-back guarantee on eligible web and WordPress hosting plans. If you are not satisfied within the first 30 days of a new hosting account, you may request a full refund of the hosting fee. Certain charges, including domain registrations and renewals, SSL certificates, add-ons, and administrative or overage fees, are non-refundable.

7. Suspension & Termination

We may suspend or terminate your account or any Service, with or without notice, if you breach these Terms or the Acceptable Use Policy, fail to pay amounts due, create a security or stability risk to our network, or where required by law or by a competent authority.

  • Wherever reasonably practicable, we will notify you of a violation and give you an opportunity to resolve it before suspension.
  • Serious violations (such as illegal content, active attacks, or activity that endangers our network or other customers) may result in immediate suspension without prior notice.
  • You may cancel your Services at any time from your client area; cancellation stops future renewals and any applicable refund is governed by our Refund Policy.
  • On termination, your right to use the Services ends immediately and we may delete your data after a reasonable grace period. You remain liable for any charges incurred up to the termination date.

8. Backups & Data Loss

We provide automated backups on many plans as a convenience and operate our infrastructure with redundancy and care. However, backups are not a substitute for your own backup strategy, and you are ultimately responsible for maintaining independent, up-to-date copies of all your data, content, code and databases.

  • We do not guarantee that any backup will be available, complete, uncorrupted or restorable at any particular time.
  • To the fullest extent permitted by law, LyfHost is not liable for any loss, corruption or unavailability of data, regardless of cause.
  • We strongly recommend you download and retain your own backups before making major changes, migrations or cancellations.

9. Limitation of Liability

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, LyfHost and Lyfsoft Technologies disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

In no event shall LyfHost, its parent, affiliates, officers, employees or suppliers be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of (or inability to use) the Services. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Services shall not exceed the amount you paid to us for the affected Service during the three (3) months immediately preceding the event giving rise to the claim.

10. Intellectual Property

All intellectual property in the Services, including the LyfHost name, logo, website, software, control panels, documentation and design, is owned by or licensed to Lyfsoft Technologies and is protected by applicable laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose. They do not transfer any ownership to you.

You retain all rights to the content you upload or create using the Services. You grant us a limited licence to host, store, process and transmit that content solely as necessary to provide the Services to you. You are responsible for ensuring you have all rights and permissions required for your content.

11. Indemnification

You agree to indemnify, defend and hold harmless LyfHost, Lyfsoft Technologies and their respective directors, employees and agents from and against any claims, damages, liabilities, losses, costs and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Services, or your breach of these Terms or applicable law.

12. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by and construed in accordance with the laws of India. You agree that the courts at Bhubaneswar, Odisha, India shall have exclusive jurisdiction to settle any dispute arising out of or relating to these Terms or the Services, subject to any non-waivable rights you may have as a consumer under applicable law.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, technology, law or business practices. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or through your client area. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Services and may cancel your account.
